§ 1 Scope of Application
(1) These General Terms and Conditions apply to all orders placed through our online shop blazewheelz.com, operated by Blaze Wheelz / Florian Matthias Brandner, Gajach 22 - 9754 Steinfeld.
(2) The contract language is German.
(3) These GTC apply exclusively. Deviating conditions of the customer are not recognized, unless we expressly agree to their validity in writing.
§ 2 Contracting Party, Conclusion of Contract
(1) The purchase contract is concluded with Blaze Wheelz / Florian Matthias Brandner.
(2) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
(3) By clicking the "Buy now" / "Order with obligation to pay" button, the customer places a binding order for the goods contained in the shopping cart.
(4) Confirmation of receipt of the order occurs immediately after the order is sent and does not yet constitute acceptance of the contract. The contract is only concluded through our express declaration of acceptance (e.g., by email) or by delivery of the goods.
§ 3 Product Information — Custom-Made-to-Order
(1) Our products are custom-made goods produced according to customer specifications (custom configuration via our 3D configurator, e.g., color selection of rim, hub, spokes, nipples, and logo).
(2) Important note: Our rims do not have an expert report and therefore no road approval. The buyer is responsible for checking the legal permissibility of use in their respective country.
(3) The customer is responsible for checking the compatibility of the rims with their vehicle model before ordering or for contacting us in advance.
§ 4 Prices and Shipping Costs
(1) The prices stated on the website are final prices.
(2) In addition to the stated prices, shipping costs will apply, which will be transparently displayed during the order process before the order is finalized.
(3) Surcharges for special equipment (e.g., custom logo) are shown separately in the configurator before the order is completed.
§ 5 Payment
(1) The following payment methods are available in the online shop: [Mastercard, Visa, Maestro, etc.
(2) Payment is due immediately upon conclusion of the contract, unless otherwise agreed.
§ 6 Delivery
(1) As these are individually manufactured custom products, the delivery time is usually [3–4 weeks] from receipt of order. We will inform the customer immediately of any delays.
(2) Delivery will be made to the delivery address provided by the customer during the ordering process within the delivery areas we offer - All EU countries.
(3) The risk of accidental loss and accidental deterioration of the sold item passes to the customer upon delivery of the item.
§ 7 Right of Withdrawal
Right of Withdrawal Information
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which the customer or a third party named by him, who is not the carrier, has taken possession of the goods.
Important note on the exclusion of the right of withdrawal for individually manufactured goods:
The right of withdrawal does not apply according to § 18 para. 1 Z 3 FAGG to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
Since our products are individually manufactured according to customer requirements (color, logo, etc.) via the 3D configurator, the right of withdrawal is generally excluded. We explicitly point this out to the customer before the order is placed.
Note: Depending on the exact design of the configurator, the exclusion may or may not apply.
§ 8 Warranty
(1) The statutory warranty provisions apply.
(2) In case of defects, the customer should contact info@blazewheelz.com immediately.
§ 9 Liability
(1) We are liable according to statutory provisions for damages resulting from a deliberate or grossly negligent breach of duty.
(2) In all other respects, liability is excluded to the extent permitted by law.
(3) Liability for damages arising from the use of the products in public road traffic is excluded, as the products are not approved for this purpose (see § 3 para. 2).
§ 10 Retention of Title
The goods remain our property until full payment has been received.
§ 11 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which can be found at http://ec.europa.eu/consumers/odr/.
§ 12 Final Provisions
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If a provision of these GTC is invalid, the remaining provisions shall remain unaffected.
